Welcome to RunPact! These Terms of Service ("Terms") govern your use of the RunPact website, applications, and services (collectively, the "Services"). Please read these Terms carefully before using our Services.
1. Service Provider
RunPact is operated by Piotr Lewanda (sole proprietor), based in Poland. You can contact us at contact@runpact.com.
2. Acceptance of Terms
By creating an account or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, you may not use our Services. You must be at least 16 years old to use RunPact.
3. User Accounts
You may be required to create an account to access certain features of our Services. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.
4. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for any content you upload, including GPX files and personal data. You grant RunPact a non-exclusive, worldwide, royalty-free license to use, process, and display your data solely to provide and improve the Services. This license ends when you delete your data or your account.
5. Intellectual Property
The RunPact software, design, text, graphics, and logos are owned by RunPact and are protected by intellectual property laws. Certain 3D assets used in our visualizations (such as tree and shrub models) are provided by third-party creators under Creative Commons licenses and remain the property of their respective authors. You may not copy, modify, distribute, or reverse-engineer any part of the Services without our prior written consent. Your uploaded data (GPX files, activity data) remains your property.
6. Features and Services
RunPact offers features including ML-powered training plans, GPX analysis, 3D course visualization, and race time predictions. The features available to you depend on your subscription plan. We reserve the right to modify, add, or remove features from any plan. The official description of features for each plan is available on our pricing page.
7. Subscription and Payments
Certain features of the Services require a paid subscription. By selecting a paid plan, you agree to pay the applicable fees. All payments are processed by Stripe — we do not store your credit card information. Subscriptions are billed in advance on a recurring basis. You can cancel your subscription at any time through your account settings, and your access will continue until the end of the current billing period.
Right of Withdrawal (EU Consumers)
Under EU consumer law, you have the right to withdraw from a digital service purchase within 14 days of subscription without giving any reason. However, by using the paid features immediately after subscribing, you acknowledge and agree that you are requesting immediate performance of the service. If you begin using paid features during the 14-day withdrawal period, you waive your right of withdrawal for the portion of the service already provided. 8. Account Deletion
You can request deletion of your account and all associated personal data at any time by contacting us at contact@runpact.com. Account deletion is permanent and will be processed within 30 days. See our Privacy Policy for details on data retention.
9. Disclaimers and Limitation of Liability
The Services are provided "as is" without any warranties of any kind, whether express or implied. RunPact does not guarantee the accuracy of any analysis, predictions, or training plans generated by our system. Training plans and race predictions are generated by algorithms and should not be considered medical or professional coaching advice. Always consult with a qualified healthcare professional before beginning any fitness program.
To the maximum extent permitted by applicable law, RunPact will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Nothing in these Terms limits your statutory rights as a consumer under applicable law.
10. Governing Law and Disputes
These Terms are governed by the laws of Poland. Any disputes arising from these Terms or the Services shall be subject to the jurisdiction of the courts of Poland.
If you are a consumer in the European Union, you may also use the EU Online Dispute Resolution (ODR) platform to resolve disputes: https://ec.europa.eu/consumers/odr. Our email for ODR purposes is contact@runpact.com.
11. Changes to Terms
We may modify these Terms from time to time. For material changes, we will notify you by email or by a prominent notice within the Services at least 14 days before the changes take effect. If you disagree with the changes, you may cancel your account before the new Terms take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
